DMCA & Copyright Policy
This page explains how EliteStream IPTV LLC handles copyright complaints under the Digital Millennium Copyright Act (DMCA) and how rights holders can submit a valid notice.
- We are a reseller — we do not host, store or stream any content ourselves.
- If you believe your rights are being infringed, send a written notice to legal@elitestreamiptv.co.
- Your notice must include the specific information required by 17 U.S.C. § 512(c)(3).
- We review every valid notice and act promptly in accordance with the DMCA.
- Bad-faith or false notices can lead to legal liability under 17 U.S.C. § 512(f).
1. Overview
EliteStream IPTV LLC respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy explains how we respond to claims that content accessible through our website or service infringes a copyright.
This policy is designed to comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and is published in accordance with the requirements applicable to online service providers. It should be read together with our Terms of Service and Privacy Policy.
2. Our role as a reseller
EliteStream IPTV LLC is an independent reseller and third-party service provider. We do not own, operate, host or control any streaming servers, broadcast infrastructure, content delivery networks or media libraries.
Our role is limited to providing paying subscribers with access credentials and configuration information that allow them to connect, through their own devices and third-party IPTV player applications, to media streams that already exist on the internet. We do not produce, upload, store or distribute any television channels, films, series, sports events or other media content.
3. We do not host content
Because we do not host, store or transmit content ourselves, we are typically not in a position to remove any specific file, stream or media asset from the internet. If a stream is being hosted or delivered by a third party, the most effective way to have it removed may be to contact the hosting provider, CDN, or platform that is actually delivering the content.
That said, we take every valid complaint seriously. Where we are able to take action within our own sphere of control — for example, by removing references to specific services from our website, disabling access within our own systems, or terminating a subscriber account — we will do so promptly.
We cooperate fully with rights holders, hosting providers and law enforcement where appropriate.
4. How to report copyright infringement
If you are a copyright owner, or an agent authorised to act on behalf of one, and you believe that content accessible through our website or service infringes your copyright, please send a written notice to our designated DMCA agent using the contact details in section 6.
To be effective, your notice must be in writing and must include all of the elements listed in section 5. Notices that do not include these elements may not be actionable under the DMCA.
5. Requirements of a valid DMCA notice
Under 17 U.S.C. § 512(c)(3), a valid DMCA notice must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorised to act on the owner’s behalf.
- Identification of the copyrighted work or works claimed to have been infringed. If multiple works are covered by a single notice, you may provide a representative list.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material. This should include specific URLs, app names, service names, or other precise identifiers.
- Information reasonably sufficient to permit us to contact you, such as your full name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of an exclusive right that is allegedly infringed, or are authorised to act on the owner’s behalf.
- Your physical or electronic signature.
6. Designated DMCA agent
Notices of claimed copyright infringement should be sent to our designated DMCA agent:
- Service Provider
- EliteStream IPTV LLC
- Agent
- Legal Department — DMCA Agent
- Address
- 2330 White Ave, Berry Hill, TN 37204, USA
- legal@elitestreamiptv.co
- Subject line
- DMCA Notice — [Name of Copyright Owner]
Email is the fastest way to reach our DMCA agent and is strongly preferred. Notices sent by post should be marked clearly as a “DMCA Notice” on the envelope and on the first page.
7. What happens after we receive a notice
When we receive a notice that substantially complies with the requirements in section 5, we will:
- Acknowledge receipt, where a valid reply address is provided.
- Review the notice and assess whether it meets the DMCA requirements.
- Take action within our sphere of control, where possible, which may include removing references from our website, disabling access through our own systems, or terminating the relevant subscriber account.
- Forward the notice to the relevant third party where that is required or appropriate, such as the actual hosting provider or platform delivering the content.
- Notify the affected subscriber, where required under the DMCA, so that they may submit a counter-notification if they believe the removal was the result of a mistake or misidentification.
8. Counter-notification
If your access has been restricted because of a DMCA notice and you believe the material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our designated agent.
Under 17 U.S.C. § 512(g)(3), a valid counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original notification or an agent of that person.
If we receive a valid counter-notification, we may forward it to the original complainant and, in appropriate circumstances, restore access to the material or account within the timeframes set out in the DMCA, unless the complainant informs us that they have filed a court action to restrain the alleged infringement.
9. Repeat infringer policy
It is our policy, in appropriate circumstances and at our discretion, to terminate the accounts of subscribers who are found to be repeat infringers of copyright.
Accounts that receive multiple valid DMCA notices, or that are shown to engage in serious or repeat infringement, may be suspended or permanently terminated without refund, in accordance with our Terms of Service.
10. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner, or by the service provider.
Please do not submit DMCA notices or counter-notices for material that you do not own, or for material that you are not authorised to act on behalf of. Do not use the DMCA process to harass competitors, suppress legitimate activity, or make false claims.
11. No retaliation for good-faith reports
We will not retaliate against any person for making a good-faith report of suspected copyright infringement, or for exercising any right protected by applicable law. The DMCA process exists to protect both copyright owners and those who are mistakenly accused.
12. Changes to this policy
We may update this DMCA & Copyright Policy from time to time to reflect changes in the law, our processes or our service. When we do, we will revise the “Last updated” date at the top of this page.
We encourage rights holders to check this page periodically for the most current version.
